ADVANCED DIRECTIVES/POWERS OF ATTORNEY - A power of attorney and health care directive are important instruments while a person is alive. In a power of attorney, a person will appoint another whom they highly trust to act on their behalf for financial and personal transactions should they become unable to do so on their own while alive. A health care directive also appoints a trusted agent to speak on their behalf, however, the focus is narrowed to their decisions for medical and end-of-life care. CONSERVATORSHIPS/GUARDIANSHIPS - As a loved ones age, or in the event of sudden incapacitation, they may lose their ability to make important decisions regarding their finances or day to day needs. When this time has come, it may be necessary for someone else to step in to assist. In a conservatorship, the Court appoints a conservator to manage, preserve, and administer finances and assets owed by and for the benefit of the protected person. A guardianship, on the other hand, is a legal proceeding in which an individual’s civil liberties are transferred to a guardian to exercise decisions regarding the health and welfare of the individual. The conservator and guardian may be the same person or they may be separate. Each role has its own legal requirements and responsibilities. ADULT GUARDIAN AD LITEM - In many elder law cases the courts will appoint a neutral attorney to represent the best interest of the elderly or disabled person. The GAL's role is to meet with your loved one, talk to any person or professional who may have information relevant to the case, and report to the court on what is in the best interest of the person who would lose their personal liberties. In some situations the GAL might have their own opinion as to what direction a case should go and will litigate for their client's best interest.
